These Terms and Conditions govern your access to and use of the BH Biolabs website, including all purchases, accounts, subscriptions, memberships, affiliate activities, content, and services offered through the website.

By accessing the website, creating an account, joining a membership, or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, you must not access the website or purchase products from BH Biolabs.

By using the website or placing an order, you represent and warrant that:

  • You have the legal capacity to enter into a binding agreement.
  • The information you provide is truthful and accurate.
  • Your purchase and intended use comply with applicable laws.

We may cancel an order or restrict access if we reasonably believe these requirements have not been satisfied.

3. Research Use Only

All laboratory research products sold by BH Biolabs are intended solely for lawful in-vitro laboratory and scientific research.

Products are not intended for:

  • Diagnostic use
  • Therapeutic use

Products are not sold as prescription drugs, over-the-counter drugs, dietary supplements, foods, cosmetics, or medical devices.

By purchasing a laboratory research product, you represent that you understand its research-only status and possess the appropriate knowledge, facilities, equipment, and qualifications to handle it safely and lawfully.

4. No Medical Advice

Nothing on the website constitutes medical, pharmaceutical, diagnostic, therapeutic, veterinary, or healthcare advice.

Website content, product descriptions, research summaries, articles, graphics, testimonials, customer reviews, and communications are provided for general informational purposes only.

You must not rely on website content for:

  3. You will comply with all federal, state, and local laws.
  4. You will follow appropriate laboratory safety and handling procedures.
  5. You will securely store and dispose of products.
  6. You will not resell products for prohibited or unlawful purposes.
  7. You will not misrepresent BH Biolabs products as approved drugs, treatments, supplements, or therapeutic products.
  8. You accept responsibility for evaluating product suitability for your intended research.

We may refuse, cancel, or limit any order if we suspect unlawful, unsafe, misleading, or prohibited use.

6. Product Information and Availability

We attempt to present product information accurately. However, product descriptions, packaging, images, availability, specifications, and pricing may change without notice.

Product images are illustrative and may differ slightly from the product received.

We do not warrant that:

  • Product descriptions are completely error-free.
  • Every product will remain available.
  • A product will produce a particular research result.
  • Website information is suitable for a specific experiment or application.

We reserve the right to discontinue products, limit quantities, correct errors, or cancel orders.

7. Orders

Submitting an order constitutes an offer to purchase. An automated order confirmation does not mean that we have accepted the order.

We may decline or cancel an order for reasons including:

  • Suspected fraud
  • Payment failure
  • Pricing errors
  • Inventory shortages
  • Shipping restrictions
  • Regulatory concerns
  • Suspected prohibited use
  • Inaccurate customer information
  • Violation of these Terms

If we cancel a paid order before shipment, we will ordinarily refund the amount charged for the canceled items.

8. Pricing and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

You agree to pay:

  • The listed purchase price
  • Applicable taxes
  • Shipping charges
  • Subscription or membership charges you expressly authorize
  • Any other charges disclosed before checkout

Prices may change without notice. A price change will not generally affect an order already accepted, unless the displayed price resulted from an obvious error.

Payments are processed by third-party payment providers. BH Biolabs does not necessarily receive or store complete payment-card information.

9. Taxes

You are responsible for applicable sales, use, excise, customs, or similar taxes, except taxes imposed directly on BH Biolabs’ income.

Where required, taxes will be calculated and collected at checkout.

10. Shipping

We currently ship exclusively within the United States.

Orders are typically processed within two to four business days. Processing time does not include carrier transit time, weekends, holidays, payment review, address verification, or unusual order volume.

Tracking information will generally be emailed after shipment.

Delivery estimates are not guarantees. Delays caused by carriers, weather, emergencies, government action, address problems, or other circumstances outside our control do not automatically entitle the customer to a refund.

Additional shipping terms are contained in our Shipping Policy, which is incorporated into these Terms.

11. Address Accuracy and Delivery

You are responsible for providing a complete and accurate shipping address.

BH Bio Labs is not responsible for delays, losses, or additional charges caused by:

  • Incorrect addresses
  • Incomplete addresses
  • Refused deliveries
  • Unclaimed packages
  • Unauthorized forwarding
  • Customer failure to retrieve a package
  • Carrier access restrictions

If a shipment is returned to us because of customer-provided information or customer action, additional shipping charges may apply.

12. Returns, Replacements, and Refunds

All sales are final.

We only consider claims involving:

  • Products damaged during shipping
  • Incorrect products sent by BH Biolabs

Claims must be submitted within 48 hours of recorded delivery by emailing support@bhbiolabs.com.

The claim must include:

  • Order number
  • Description of the issue
  • Clear photographs of the product
  • Photographs of the packaging and shipping label
  • Any additional information reasonably requested

Do not discard the product or packaging until the claim is resolved.

If a claim is approved, BH Biolabs may, at its discretion:

  • Replace the affected product
  • Issue store credit
  • Issue a partial refund
  • Issue a refund to the original payment method

Original shipping charges are generally nonrefundable unless required by law or the error was caused solely by BH Bio Labs.

13. Memberships and Subscriptions

Certain VIP memberships or other services may renew automatically.

Before enrollment, we will disclose material terms such as:

  • Price
  • Billing frequency
  • Included benefits
  • Renewal terms
  • Cancellation method
  • Trial terms, if any

By enrolling, you authorize recurring charges until cancellation.

You are responsible for canceling before the next renewal date to avoid the next charge. Cancellation applies to future billing and ordinarily does not create a refund for charges already processed.

Any recurring plan must use clear disclosures, affirmative consent, authorized billing, and a reasonably accessible cancellation process. FTC guidance emphasizes that recurring charges require express consent and must not be imposed through silence or unclear negative-option practices.

14. Affiliate Program

Participation in the affiliate program is subject to separate Affiliate Terms.

Unless otherwise stated in a written affiliate agreement:

  • Approved affiliates earn 10% on verified qualifying sales.
  • Payouts are processed on the 15th of each month for the previous month.
  • A minimum approved balance of $50 is required.
  • Returned, canceled, fraudulent, disputed, self-referred, or otherwise invalid orders do not qualify.
  • Affiliates may not make medical, therapeutic, disease, dosing, human-use, or misleading claims.
  • Affiliates must clearly disclose their material relationship with BH Biolabs.

FTC guidance requires endorsers and businesses to disclose material connections clearly and conspicuously, and endorsements must be truthful and not misleading.

We may withhold commissions, suspend accounts, or terminate participation for violations.

15. Accounts and Security

You may be required to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Restricting access to your device
  • Providing accurate account information
  • Promptly notifying us of suspected unauthorized access
  • Activities conducted through your account

We may suspend or terminate an account that is fraudulent, insecure, abusive, unlawful, or in violation of these Terms.

16. Prohibited Conduct

You may not:

  • Use the website for unlawful purposes
  • Purchase products for human or animal use
  • Make false medical or therapeutic claims
  • Resell products in a misleading or unlawful manner
  • Circumvent age, checkout, or compliance controls
  • Interfere with website security or operation
  • Introduce malware or harmful code

  • Impersonate another person
  • Commit payment fraud or chargeback abuse
  • Copy protected content without permission
  • Use BH Biolabs trademarks in misleading advertising

  • It does not encourage human consumption or unlawful use.
  • It does not contain prohibited medical or therapeutic claims.
  • It is not fraudulent, defamatory, obscene, or misleading.

We may moderate or remove content that violates these standards.

Submission of content grants BH Bio Labs a nonexclusive, worldwide, royalty-free license to reproduce, display, adapt, and distribute the content in connection with our business, subject to applicable law.

18. Intellectual Property

The website and its content, including text, graphics, logos, product photographs, software, design, layout, and branding, are owned by or licensed to BH Bio Labs and protected by applicable intellectual-property laws.

You may use the website only for personal or internal business purposes related to lawful purchasing.

You may not reproduce, modify, distribute, sell, sub-license, or commercially exploit website content without prior written permission.

21. Assumption of Risk

  • Unauthorized access

You are responsible for establishing appropriate safeguards, training, facilities, and procedures.

22. Limitation of Liability

To the fullest extent permitted by law, BH Biolabs and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages.

This includes:

  • Lost profits
  • Lost data
  • Research loss
  • Business interruption
  • Personal injury caused by misuse
  • Third-party claims
  • Unauthorized use
  • Carrier delays

To the fullest extent permitted by law, our total liability relating to a product, order, or claim will not exceed the amount paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some provisions may not apply.

23. Indemnification

You agree to defend, indemnify, and hold harmless BH Biolabs and its owners, officers, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

24. Regulatory Compliance

You are responsible for determining whether you may lawfully purchase, possess, store, handle, transport, research, or resell a product.

BH Biolabs does not represent that every product is lawful or appropriate in every jurisdiction or application.

We may cooperate with lawful government, regulatory, court, carrier, or payment-provider requests.

25. Electronic Communications

You consent to receive transactional communications electronically, including:

  • Order confirmations
  • Shipping notices
  • Account messages
  • Policy notices
  • Subscription communications

Marketing emails may be subject to separate consent and unsubscribe rights.

Electronic records and communications satisfy requirements that information be provided in writing where legally permitted.

26. Fraud, Chargebacks, and Payment Disputes

Before initiating a chargeback, you should contact support@bhbiolabs.com so we can attempt to resolve the issue.

Fraudulent chargebacks, false claims, or payment abuse may result in:

  • Account termination
  • Order cancellation
  • Collection activity
  • Evidence being submitted to the payment provider
  • Reporting to appropriate authorities where lawful

Nothing in this section limits legitimate consumer rights.

27. Force Majeure

BH Biolabs is not liable for delay or failure caused by circumstances beyond reasonable control, including:

  • Carrier disruption
  • Natural disaster
  • Severe weather
  • Fire
  • Epidemic or public-health event
  • Labor dispute
  • Internet outage
  • Cyberattack
  • Supply interruption
  • Government action
  • Regulatory restrictions

28. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

Subject to applicable consumer law, disputes will be brought in a court of competent jurisdiction located in Clark County, Nevada.

29. Severability

If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

The invalid provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted.

30. No Waiver

Failure to enforce a provision does not waive our right to enforce it later.

31. Assignment

You may not assign your rights or obligations under these Terms without our written permission.

BH Biolabs may assign its rights and obligations in connection with a merger, acquisition, sale, reorganization, or transfer of business assets.

32. Changes to These Terms

We may update these Terms to reflect changes in law, products, services, technology, or business practices.

The revised version will be posted with a new effective date.

Continued use after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes affecting subscriptions or previously authorized charges will be handled according to applicable law and any separate agreement.

33. Entire Agreement

These Terms, together with incorporated policies, constitute the agreement between you and BH Biolabs regarding the website and purchases.
